1. About these terms
Welcome to Moxie Living. These Terms and Conditions ("Terms") govern your use of www.moxieliving.com (the "Site") and any content, resources, emails, quizzes, products and programmes we offer (together, the "Services").
The Site and Services are operated by Moxie Living ("Moxie Living", "we", "us" or "our"), run by Lisa Byrnes, based in New Zealand.
By using the Site or signing up for any of our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Services.
2. What Moxie Living is
Moxie Living is a content and community brand about the emotional and psychological side of ageing and starting over, for women rebuilding their lives after a major life change. We share writing, resources, quizzes, a newsletter and digital products created from Lisa's own experience and reflection.
Our content is created to inform, support and accompany. It is not a service that diagnoses, treats or provides professional care of any kind.
3. Our content is not professional advice
This is important, so please read it carefully.
Everything Moxie Living publishes, including the Site, our emails, guides, quizzes, journals and programmes, is provided for general information, reflection and support only. It reflects personal experience and opinion.
Our content is not, and is not a substitute for:
- medical, health or pharmaceutical advice
- psychological, psychiatric, counselling or therapeutic advice or treatment
- legal advice
- financial or tax advice
Moxie Living does not provide medical advice and makes no claims about menopause, ageing, symptoms, treatments, supplements or protocols. Nothing we share should be relied upon as a reason to start, stop or change any treatment or professional support.
Always seek the advice of a qualified professional for any question relating to your physical health, mental health, legal situation or finances. Never disregard or delay seeking professional advice because of something you have read or received from Moxie Living.
If you are in crisis or distress, please contact a qualified professional, your local health service, or an emergency service in your country. Moxie Living is not a crisis or emergency service.
4. No guarantee of results
Our content and products are designed to support and encourage you, but everyone's circumstances are different. We make no promises or guarantees about any particular outcome, result or change in your life from reading our content or taking part in our products or programmes. Any decisions you make are your own responsibility.
5. Who can use the Services
You may browse the Site freely. To purchase a product, join a programme or sign up to our email list, you confirm that you are at least 18 years old and able to enter into a binding agreement. Our Services are intended for adults and are not directed at children.
6. Intellectual property
All content on the Site and in our products, including text, writing, guides, journals, quizzes, graphics, design, logos, the Moxie Living name and brand, and the tagline "We Don't Fade | We Ignite", is owned by Moxie Living or used under licence, and is protected by copyright and other intellectual property laws.
You may read, enjoy and share links to our content for your own personal, non-commercial use. You may not, without our written permission:
- copy, reproduce, republish or distribute our content
- resell, share or give away any product or programme you have purchased
- use our content or brand for any commercial purpose
- remove any copyright or ownership notices
When you buy a digital product, you receive a personal, non-transferable licence to use it for your own use. You do not own the underlying content.
7. Acceptable use of the Site
When using the Site and Services, you agree not to:
- use them for any unlawful or harmful purpose
- attempt to gain unauthorised access to the Site or any system behind it
- interfere with or disrupt the Site or its security
- copy, scrape or harvest content or data except as expressly allowed
- impersonate any person or misrepresent your connection to anyone
We may suspend or end your access to the Services if you breach these Terms.
8. Content you submit
If you submit anything to us, such as quiz responses, email replies, comments or messages, you confirm it is your own and does not infringe anyone else's rights. You grant us permission to use that information to provide and improve our Services, in line with our Privacy Policy. We may remove any content we consider inappropriate, unlawful or in breach of these Terms.
9. Emails and communications
By signing up, you agree to receive the emails you requested, which may include resources, our newsletter and updates about our products and programmes. You can unsubscribe from marketing emails at any time using the link in any email. Service messages relating to a purchase may still be sent.
10. Purchases, products and programmes
From time to time we offer paid digital products and programmes.
- Payment. Purchases are processed through a third-party platform (such as Gumroad) and its payment processors. By buying, you also agree to that platform's terms. We do not store your full payment details.
- Pricing. Prices are shown at the point of purchase and may be in New Zealand Dollars or another currency as indicated. We may change our prices at any time, but changes will not affect purchases already made.
- Delivery. Digital products are usually delivered electronically, by download or email, shortly after purchase.
- Refunds. Because our products are digital and delivered immediately, we generally do not offer refunds once a product has been delivered or a programme has begun, except where you are entitled to a remedy under the law that applies to you (for example, the New Zealand Consumer Guarantees Act or equivalent consumer protection law in your country, such as where a product is faulty or not as described). If something is wrong with your purchase, contact us and we will put it right.
Note to confirm: set your final refund position and currency, and make sure it matches what your selling platform shows at checkout.
11. Third-party links and platforms
The Site and our Services may link to or rely on third-party websites and platforms, such as our email provider, payment platform and social media accounts. We do not control these third parties and are not responsible for their content, products or practices. Your use of them is at your own risk and subject to their terms.
12. Disclaimers
The Site and Services are provided on an "as is" and "as available" basis. While we take care with what we create, we do not warrant that the Site will be uninterrupted, error-free or secure, or that any content is complete, accurate or current. To the fullest extent permitted by law, we exclude all warranties that are not expressly set out in these Terms.
Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.
13. Limitation of liability
To the fullest extent permitted by law, Moxie Living, Lisa Byrnes, and anyone working with us will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, data or goodwill, arising from your use of, or inability to use, the Site or Services, or from reliance on any content we provide.
Where liability cannot be excluded but can be limited, our total liability to you is limited to the amount you paid us for the relevant product or programme, or, if you have not paid us anything, to NZD $100.
14. Indemnity
You agree to indemnify and hold harmless Moxie Living and Lisa Byrnes from any claims, losses or costs arising from your breach of these Terms or your misuse of the Site or Services.
15. Privacy
Your use of the Site and Services is also governed by our Privacy Policy, which explains how we collect and use your personal information. Please read it alongside these Terms.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Significant changes may be notified by email or a notice on the Site. Your continued use of the Site or Services after an update means you accept the revised Terms.
17. Suspension and termination
We may suspend, restrict or end your access to all or part of the Site or Services at any time, without notice, if we reasonably believe you have breached these Terms or if we need to for legal, security or operational reasons.
18. Governing law
These Terms are governed by the laws of New Zealand. Any dispute relating to these Terms or the Services will be subject to the non-exclusive jurisdiction of the courts of New Zealand. If you are a consumer in another country, you may also have the benefit of mandatory protections under the law of the country where you live.
19. General
If any part of these Terms is found to be invalid or unenforceable, the rest will continue to apply. Our failure to enforce any right does not waive that right. These Terms, together with our Privacy Policy, make up the entire agreement between you and Moxie Living regarding the Site and Services.
