1. Who we are

This Privacy Policy explains how Moxie Living ("Moxie Living", "we", "us" or "our"), operated by Lisa Byrnes, collects, uses, stores and protects your personal information when you visit www.moxieliving.com (the "Site"), sign up to our email list, take part in our quizzes, or purchase or join any of our products or programmes.

Moxie Living is based in New Zealand. We serve an international audience, so this policy is written to respect the New Zealand Privacy Act 2020 as well as the privacy rights of visitors in the United Kingdom, the European Economic Area (EEA), Australia, the United States and elsewhere.

For the purposes of data protection law, Moxie Living is the controller of your personal information.

2. What this policy covers

This policy covers the Site and any related sign-up forms, quizzes, lead magnets (such as our free guide), waitlists, newsletters and digital products that link to it.

It does not cover third-party websites or services we link to, or the platforms we use to deliver our products. Those services have their own privacy policies, and we encourage you to read them. We name the main ones in Section 6.


3. The information we collect

Information you give us

  • Contact details. When you sign up for our free guide, take a quiz, join a waitlist or subscribe to our newsletter, we collect the information you enter, which is usually your email address and sometimes your first name.
  • Quiz responses. If you complete a quiz, we collect the answers you select so we can send you a relevant result and the right resources.
  • Purchase information. If you buy a digital product or join a paid programme, your payment is handled by a third-party platform (see Section 6). We do not collect or store your full card details. We may receive your name, email address and a record of your purchase.
  • Anything you send us. If you email us, reply to a newsletter, or otherwise get in touch, we keep a record of that correspondence.

Information we collect automatically

When you visit the Site, some information may be collected automatically through cookies and similar technologies, including:

  • your IP address and approximate location
  • your device and browser type
  • the pages you visit and how you arrived at the Site
  • general usage and analytics data

This information helps us understand how the Site is used and how we can improve it. See Section 5 for more on cookies.

Sensitive information

Moxie Living writes about the emotional and psychological side of ageing and starting over. We do not ask you to share health information, and we do not knowingly collect special category or sensitive data. Please do not send us sensitive personal details through our forms.


4. How we use your information

We use your personal information to:

  • send you the free guide, quiz result or other resource you requested
  • deliver our newsletter and other emails you have asked to receive
  • manage waitlists and let you know when something opens
  • process and fulfil your purchases and provide customer support
  • personalise the content and emails we send you
  • understand how the Site is used and improve it
  • keep our records accurate and respond to your enquiries
  • comply with our legal obligations and protect our rights

We will only send you marketing emails where you have signed up to receive them, and you can unsubscribe at any time (see Section 11).

Our legal bases (for EEA and UK visitors)

Where data protection law in the EEA or the UK applies to you, we rely on the following legal bases:

  • Consent, for sending you marketing emails and the resources you sign up for. You can withdraw consent at any time.
  • Contract, for delivering products or programmes you have purchased.
  • Legitimate interests, for running, securing and improving our Site and business, in a way that does not override your rights and freedoms.
  • Legal obligation, where we are required to keep or disclose information by law.

5. Cookies and tracking

Our Site uses cookies and similar technologies. Cookies are small text files stored on your device that help a website function and help us understand how it is used.

We may use:

  • Essential cookies, which are needed for the Site to work properly.
  • Analytics cookies, which help us understand how visitors use the Site so we can improve it.
  • Functional cookies, set by tools such as our forms and embedded content.

You can control or delete cookies through your browser settings. Turning off some cookies may affect how the Site works.

Note to confirm: if you add or change analytics tools (for example Google Analytics) or a cookie consent banner, update this section to name them and describe how visitors can opt out.


6. Who we share your information with

We do not sell your personal information. We share it only with the service providers we use to run Moxie Living, and only as needed to provide our services to you. These include:

  • Kit (ConvertKit), our email marketing platform, which stores your email address and name and delivers our guides, quiz results and newsletters. Kit is based in the United States.
  • Lovable, the platform that hosts and powers our Site.
  • Gumroad (or a similar platform), which processes payments and delivers our digital products if and when you make a purchase. Payment details are handled by the platform and its payment processors, not by us.
  • Embedded services, such as web fonts and any content we embed, which may receive limited technical information such as your IP address in order to load correctly.

We may also disclose your information where we are required to do so by law, to enforce our Terms and Conditions, or to protect the rights, safety or property of Moxie Living or others.

7. International transfers

Because we use service providers based in the United States and elsewhere, your personal information may be transferred to, stored in, or processed in countries outside your own, including countries that may not offer the same level of data protection as your home country.

Where we transfer information out of the EEA or the UK, we rely on the safeguards offered by our providers, which may include standard contractual clauses or equivalent protections. By using the Site and our services, you understand that your information may be processed in this way.


8. How long we keep your information

We keep your personal information for as long as we need it for the purposes set out in this policy, including:

  • for as long as you remain subscribed to our emails, plus a reasonable period afterwards
  • for as long as required to provide and support a product or programme you have bought
  • for as long as needed to meet our legal, accounting or reporting obligations

When we no longer need your information, we will delete it or anonymise it.


9. How we keep your information safe

We take reasonable steps to protect your personal information from loss, misuse, unauthorised access and disclosure, and we rely on reputable providers (such as Kit, Lovable and our payment platform) who maintain their own security measures.

No method of transmission or storage is completely secure, so while we do our best to protect your information, we cannot guarantee its absolute security.


10. Your rights

Depending on where you live, you have rights over your personal information. These may include the right to:

  • access the personal information we hold about you
  • correct information that is inaccurate or out of date
  • delete your information, where there is no legal reason for us to keep it
  • object to or restrict how we use your information
  • withdraw consent at any time, including by unsubscribing from our emails
  • request a copy of your information in a portable format

To exercise any of these rights, email us at [lisa@moxieliving.com]. We will respond within the time required by the law that applies to you. We may need to verify your identity before acting on a request.

If you are in the EEA or the UK

You also have the right to lodge a complaint with your local data protection authority if you believe we have not handled your information properly.

If you are in New Zealand

You can also raise a concern with the Office of the Privacy Commissioner.

If you are in California

You have the right to know what personal information we collect, to request its deletion, and not to be discriminated against for exercising your rights. We do not sell your personal information.


11. Marketing and unsubscribing

If you have signed up to hear from us, we will send you emails such as our newsletter, your requested resources, and occasional updates about our products and programmes.

Every marketing email includes an unsubscribe link. You can opt out at any time, and we will stop sending you marketing emails. We may still send you essential messages relating to a product you have purchased.


12. Children

Moxie Living is intended for adults. The Site and our products are not directed at children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us their information, please contact us so we can remove it.


13. Links to other sites

Our Site and emails may contain links to other websites, platforms and social media accounts. We are not responsible for the privacy practices or content of those third parties. Once you leave our Site, this policy no longer applies, so please review the privacy policy of any site you visit.


14. Changes to this policy

We may update this policy from time to time to reflect changes in our practices, our tools or the law. When we do, we will change the "Last updated" date at the top of this page. If the changes are significant, we will let you know by email or through a notice on the Site. Your continued use of the Site after an update means you accept the revised policy.
